1. Introduction

These Terms and Conditions (“Terms”) govern the vehicle purchase service provided by Kent Car Buyer (“we”, “us”, “our”) operating at kentcarbuyer.co.uk. By submitting a vehicle valuation request, accepting a purchase offer, or proceeding with the sale of your vehicle to Kent Car Buyer, you (the “Seller”) agree to be bound by these Terms in full.

Kent Car Buyer is a professional vehicle buying service operating throughout Kent and surrounding postcodes. We purchase used vehicles from private sellers for resale into the trade market.

2. The Purchase Process

2.1 Valuation & Offer

All offers are made following a manual assessment of the information provided by the Seller, including registration number, mileage, condition, service history, and any known faults declared at the time of enquiry. Valuations are based on real-time market data and our trading experience.

2.2 Price Agreement

The agreed purchase price is fixed at the point of written or verbal acceptance by both parties prior to any collection or inspection appointment being arranged. The Seller must ensure that all information provided during the valuation stage is accurate and complete.

IMPORTANT: The agreed price may be revised only if the physical condition of the vehicle at the point of inspection differs materially from the description provided during the valuation stage. Any such revision will be discussed and must be agreed upon by both parties before the sale proceeds.

2.3 Vehicle Inspection

At the time of collection or appointment, Kent Car Buyer will carry out a physical inspection of the vehicle to verify the condition against the details provided. If the vehicle is found to match the description given, the originally agreed price will stand without amendment.

3. Finality of Sale — No Returns, No Refunds

ALL SALES ARE FINAL. Once payment has been made and the vehicle has transferred to Kent Car Buyer, the transaction is complete and irrevocable. The Seller has no right to cancel the sale, request the return of the vehicle, or claim any refund of the purchase price under any circumstances.

By accepting payment from Kent Car Buyer, the Seller acknowledges and agrees that:

The sale is concluded on the date and at the time of payment.
Ownership of the vehicle transfers to Kent Car Buyer immediately upon payment.
Kent Car Buyer is a trade buyer and vehicles are processed for onward sale into the trade market immediately following purchase. Due to the operational nature of this business, it is not possible to reverse, unwind, or cancel any completed transaction.
No right of cancellation, return, or refund exists once payment has been made, regardless of the circumstances.
The Consumer Contracts Regulations 2013 right to cancel does not apply to this transaction, as this is a sale of a vehicle by a private individual to a trade buyer and does not constitute a consumer purchase.

The Seller is strongly advised to ensure they are entirely satisfied with the agreed price and all terms of the transaction before accepting payment. If the Seller has any concerns or questions, these must be raised and resolved before the sale is completed.

4. Payment

Kent Car Buyer will pay the agreed purchase price via one of the following secure, traceable payment methods:

Bank Transfer (BACS/Faster Payments)
Banker’s Draft

Payment is made on the day of collection, at the point of vehicle handover. Cash payments are not made. Both parties agree that payment by bank transfer or banker’s draft constitutes full and final settlement of the agreed purchase price.

The Seller should ensure that their bank account details provided for payment are accurate. Kent Car Buyer accepts no liability for delays or errors resulting from incorrect account information supplied by the Seller.

5. Seller Warranties & Representations

By proceeding with the sale, the Seller warrants and represents to Kent Car Buyer that:

They are the registered keeper and legal owner of the vehicle, with full authority to sell it.
The vehicle is free from any hire purchase, finance agreements, or other encumbrances, unless a separate arrangement has been agreed in writing with Kent Car Buyer prior to sale.
All information provided during the valuation and booking process is true, accurate, and complete to the best of the Seller’s knowledge.
The vehicle has not been reported stolen and is not subject to any police investigation, court order, or legal dispute.
The V5C logbook (vehicle registration document) will be provided at the time of sale. Kent Car Buyer cannot legally complete the purchase without the V5C document.
The declared mileage is genuine and has not been tampered with or altered.
The Seller has disclosed all known faults, damage, accident history, and mechanical issues affecting the vehicle.

Where any warranty or representation made by the Seller is found to be materially false or misleading, Kent Car Buyer reserves the right to take appropriate legal action and recover any resulting losses from the Seller.

6. Vehicles with Outstanding Finance

Where a vehicle is subject to an outstanding finance agreement, the full settlement balance must be cleared before ownership can legally transfer. Kent Car Buyer offers two options:

The Seller settles the finance balance directly with their finance provider and provides written confirmation of full settlement at or before the time of collection.
Kent Car Buyer deducts the settlement figure from the agreed purchase price and pays the finance company directly on the Seller’s behalf. The Seller must obtain the settlement figure from their provider and provide written confirmation of the amount.

Where the settlement balance exceeds the agreed vehicle purchase price, the Seller is responsible for making up the difference, either by settling the shortfall directly with the finance company or by providing a Banker’s Draft to Kent Car Buyer payable to the finance provider at the time of collection.

7. Limitation of Liability

Kent Car Buyer’s liability to the Seller is limited strictly to the agreed and unpaid purchase price in circumstances where Kent Car Buyer fails to make payment following a completed and lawfully constituted transaction.

Kent Car Buyer accepts no liability for any indirect, consequential, or economic losses arising from the sale, including but not limited to: loss of use of the vehicle following sale, loss of earnings, or any costs incurred in connection with making arrangements based on anticipated receipt of funds.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot be lawfully excluded under English law.

8. Data Protection & Privacy

Kent Car Buyer will collect and process personal data provided by the Seller solely for the purpose of administering the vehicle purchase transaction. This includes, but is not limited to, name, contact details, bank account information, and vehicle ownership records.

Personal data is handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Kent Car Buyer will not sell or share personal data with third parties except where required to complete the transaction (e.g., DVLA transfer of ownership) or where required by law.

9. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Amendments to These Terms

Kent Car Buyer reserves the right to update or amend these Terms at any time. The version of these Terms in force at the time the Seller accepts an offer or proceeds with a transaction shall apply to that transaction. The current version of these Terms is available at all times at kentcarbuyer.co.uk.
